Terms and Conditions for Use of Golf Buggy.

Background to Conditions for use of Golf Buggy

A. J.A.C. Pty Ltd A.C.N. 010 889 933 ("Owner") owns a Residence at 12 Trochus Place, Tangalooma Resort, Tangalooma ("Owner's Residence") and as part of the facilities available for use as part of the rental for qualified guests is a Yamaha Golf Buggy registration number C59236 ("Golf Buggy").
B. The Owner's Residence is part of the Resort operated by Tangalooma Holdings Pty Ltd ("Resort Owner") and, as such, the Owner must comply with the rules and regulations published by the Resort Owner relating to the use and occupation of the Owner's Residence and any Resort facilities including the Resort's roadways and the use of motorised transport on the roadways especially use of vehicles such as the Golf Buggy.
C. If you rent the Owner's Residence for any period and request that the Owner make the Golf Buggy available for your use during your period of rental, you agree to do so in accordance with the terms and conditions which follow.

Your Agreement with us

1. You agree to use the Golf Buggy strictly in accordance with these terms and conditions.
2. Prior to the Owner making the Golf Buggy available for your use, you must:
2.1 pay to the Owner by way of a security deposit the sum of $200-00 or such extra sum as the Owner may demand based upon the recommendations of the Resort Owner to secure your obligations under this Agreement;
2.2 advise the Owner of the details of your nominated driver(s) of the Golf Buggy including their:
(a) full names, addresses and current ages;
(b) Drivers' Licence Numbers and expiry dates.
3. You must use the Golf Buggy strictly in accordance with the following:
3.1 Only your nominated drivers are authorised to drive the Golf Buggy.
3.2 All nominated drivers must be over the age of 25 years and must hold a current open driver's licence.
3.3 No nominated driver shall drive the Golf Buggy whilst under the influence of alcohol or drugs.
3.4 The Golf Buggy must be housed each night in the Owner's garage within the Owner's Residence.
3.5 You must keep the Golf Buggy batteries fully charged using the Owner's charging unit.
3.6 You must only drive the Golf Buggy on the Resort's designated roadways as shown on the plan attached to the windscreen of the Golf Buggy.
3.7 You and each nominated driver must strictly observe any lawful direction given to them about the use of the Golf Buggy by any officer or employee of the Resort Owner.
3.8 You must ensure that no one smokes cigarettes or cigars whilst the Golf Buggy's battery system is being charged.
3.9 You must pay any fine or penalty imposed by the Resort as a result of your improper use of the Golf Buggy within the Resort.
3.10 You must generally take care of and use the Golf Buggy in a reasonable and responsible manner and must ensure that the Golf Buggy is protected from theft or damage at all times.
4. You agree to generally indemnify the Owner against any loss, cost, damage, expense or liability ("damage") which the Owner may suffer or incur as a result of your use of the Golf Buggy however that liability arises including negligent use and including all fines or penalties imposed by the Resort Owner as a result of your use of the Golf Buggy.
5. Should you incur any damage or any fine or penalty from the Resort Owner, the Owner shall be entitled to use the Security Deposit to meet the cost of such damage, fine or penalty. Any excess of the Security Deposit remaining after payment of such damage, fine or penalty shall be refunded by the Owner to you in accordance with the provisions of clause. Any shortfall after use of the Security Deposit shall be a debt immediately payable by you to the Owner upon demand.
6. If the Owner does not use the Security Deposit under clause 5 to meet the cost of any damage, fine or penalty, the Owner agrees to refund the Security Deposit or any excess under Clause 5 within 30 days of expiry of your rental period.
